Terms of Trade
Prices or fees charged are based on the published fees and prices at the date of invoicing. Fees and prices include GST at 12.5% unless indicated. To claim any discount offered for prompt payment you must make the entire payment to us in cash or by cheque or direct credit (credit card payments do not qualify) before the close of school on the day the discount expires, which is normally the first day of a term.
Postage is added to all purchases of books or publications. Anything you buy from us can be returned to us if you send it back unused and in good condition within ten days of your having received it. You pay the postage but we will refund the purchase price after your payment has been cleared by the bank.
Loans: Any text books, printed matter or other resources issued to you or your children on loan remain the property of the school. They are to be returned in good condition at your expense on demand. Loaned resources not returned by the due date or returned damaged will be charged for at replacement value.
Payment and Ownership: You must pay us in New Zealand currency for all goods supplied as soon as they are received at the address given to us when you ordered them unless we have agreed to a different arrangement. Ownership of all goods remains with us until you have paid us the purchase price and any other charges including delivery charges relating to those goods and all other goods you have purchased from us. If you sell any goods supplied by us before you own them, the proceeds of that sale will be ours. Until you own the goods and all other goods supplied by us to you, we have the right at any time in our absolute discretion and without notice to resume possession of any of those goods. To do this we or our agents may enter your premises or any premises in which the goods are situated and take possession of and remove those goods without being responsible for any damage caused. If we resell any of those goods, you will be liable for any shortfall remaining after the proceeds of the sale have been applied to the payment you owe us. :
Claims: The provision of educational services to children is only made on condition that parents or guardians give us an indemnity in the form supplied by us and printed in the enrolment forms. We cannot guarantee any educational outcomes either from the tuition we give or goods we sell, and we cannot be held liable for any loss or damage you may suffer from tuition, advice, counsel or goods supplied. We will however promptly replace or refund the purchase price of any goods that are defective when we sell them to you.
Default in Payment: If you do not pay us by the due date, at our absolute discretion you may be charged interest on any unpaid amount at the rate of 20% pa from the date payment was due until payment has been made, tuition and service may be withdrawn, and legal proceedings undertaken to recover payment owing. None of these actions will reduce your obligation to make payment in full, and you will be liable for any costs we incur in securing payment from you.
Jurisdiction
This website is governed by, and is to be interpreted in accordance with, the laws of New Zealand.
